How tall can your gate actually be?
Ely has a substantial conservation area and a concentration of listed buildings around the cathedral and the older streets, so planning comes up here more than in most Cambridgeshire towns. The rule people most often get wrong is the one about height, and it is worth understanding before you settle on a design.
Under permitted development in England, a gate or boundary structure adjoining a highway used by vehicles may be no more than one metre tall without consent. Elsewhere on the boundary the limit is two metres. One metre is low — roughly waist height — which means the great majority of driveway gates facing a road technically need permission, whatever the property.
In practice many are installed without it and never challenged, but that is a risk rather than a plan, and it becomes a real problem at the point of sale when a buyer's solicitor asks. What happens if a gate was installed without permission?
It is generally enforceable for four years from installation, after which it usually becomes immune. The more common difficulty arises at sale, when a buyer's solicitor asks for documentation that does not exist. Retrospective applications are possible but not guaranteed, which is why it is worth establishing the position at the outset.
